Michigan has many top notch criminal defense lawyers, but it suffers from far too few dedicated DUI defense attorneys. Traffic Violations
Client was stopped for speeding and weaving along a hilly stretch of road, with the officer claiming that he could see the vehicle traveling in and out of his lane of travel. He was arrested after submitting to field sobriety tests and a PBT. His Datamaster test result was over the legal limit.
Misdemeanors
I filed motions challenging the arrest. The officer did not witness a misdemeanor that occurred in his presence, and--even if he had reason to believe that a misdemeanor might have occurred ealier in the evening--an officer cannot arrest someone for a misdemeanor committed outside the officer's presence, which runs afoul of federal constitutional rights and the common law. This motion was denied by the trial court judge, and the matter was scheduled for a jury trial.

Murder
AGAIN: DON'T WAIVE YOUR RIGHTS. You might spend the night in jail, but it is far worse for you to cave into pressure and admit guilt or offer permission to search your vehicle. KEEP IN MIND THAT POLICE OFFICERS CAN BE VERY PERSUASIVE. The government has trained Officer Friendly on how to intimidate you, and that training is so good that innocent people have found themselves on death row for murder convictions based upon false confessions. Look at this: Innocence Project False Confessions and read John Grisham's book "The Innocent Man." Some pretty scary stuff!
Prostitution
Plaintiff argues that because the case concerned his blood alcohol level, there was no ongoing investigation other than awaiting the results of his blood alcohol testing. We disagree. Defendant submitted an affidavit from the investigating officer explaining that at the time of the request, only six days after plaintiff's arrest, there were several aspects of the investigation that were not complete. The officer also averred that the investigation was not limited to whether plaintiff had been driving under the influence of alcohol because plaintiff was found in a location specifically identified by the police as one known for narcotic trafficking, prostitution, and vehicular larcenies. Under these circumstances, we agree with the trial court that declining a FOIA request made so shortly after the arrest was not improper.
In a few jurisdictions, however, if a person is involved in a property damage accident, the prosecutor maintains policies that do not permit reduction from OWI to OWVI.
Your prior experience with lawyers is probably very limited, if you have any experience at all. You probably don’t know what attorneys normally charge or how to distinguish a mediocre lawyer from a great lawyer. A lot of people rely upon word of mouth, which isn’t necessarily a bad place to start, but word of mouth assumes that your friends and family know a good drunk driving lawyer. You can turn to a local attorney, but chances are pretty good you’ll end up with a general practitioner or worse. Be forewarned that divorce attorneys and personal injury lawyers are more than happy to take on a drunk driving case as supplemental income, and there are no prerequisites that prevent a lawyer--regardless of the lawyer’s level of skill, knowledge, or normal area of practice--from advertising as a DUI defense lawyer.
