Sex Crimes
The statistics on nursing home abuse are dismaying, and likely represent only a small fraction of elder abuse incidents. More than 40% of nursing home residents have reported abuse, and 90% say they or another resident of the facility have suffered neglect. Furthermore, for every incident of abuse reported more than 20 go unreported, according to California Advocates for Nursing Home Reform. Even in the most serious cases of physical and sexual assault (defined as any incident requiring emergency room treatment), a shocking 28% are not reported to the police.
Theft
Misdemeanors
Section c covers injuries incurred in circumstances not likely to cause grievous bodily harm or death. This lack of deadly or serious injury puts the crime into the category of a misdemeanor.
Embezzlement
Sections d and e of the code relate to financial crimes, including property theft and embezzlement. Whether financial elder abuse is perpetrated by a caretaker or a third party, they can face two to four years in prison; or up to a year in county jail plus a $1,000 fine for theft offences involving property valued at less than $950. If the amount stolen exceeds $950, the case may be charged as a misdemeanor or as a felony – the latter carrying a sentence including potential prison time, or up to a year in county jail.
Murder
Before beginning his work as an attorney on behalf of victims of elder abuse, Mr. Dudensing spent numerous years as a criminal prosecutor in the Sacramento District Attorneys’ office. In that position, he tried scores of cases, including complex cases of murder, attempted murder, child molest, gang crimes, and elder abuse. These years allowed Mr. Dudensing to hone his skills as a trial lawyer in a way that is very difficult to do in the civil arena because trials are far less frequent in civil law. Performing trials is sometimes compared to learning how to drive or ride a bike. Do you remember the first time you drove a vehicle in traffic? Everything seemed so chaotic and scary! But later as you gained more experience, driving became second nature. The same applies to trials. Trials are demanding experiences, and it takes many, many trials before attorneys are able to be effective in such a high pressure setting. Experienced trial attorneys make trying cases look relatively easy, but they are not! Mr. Dudensing has been through years and years of trial work both in the criminal and civil arenas. He has tried well over fifty cases to verdict. This trial work uniquely suits him to represent victims of elder abuse in civil litigation.
