Child Support
Two primary factors in calculating support are each party’s gross monthly income and the percentage of time each parent has custody of the children. If a parent has a small percentage of time with the children, the amount of child support can be substantial. There can be serious disputes regarding between parties regarding how much each of them earns (or “should” earn) and how much time each has (or should have) the children in their car.
Child Custody and Visitation
J ackie L. Paternity
Premarital Agreement
If you have a Premarital Agreement or a Postnuptial Agreement that sets forth how you and your spouse will divide your assets and debts in the event of a divorce, that agreement will usually control, unless there is a basis to have the agreement “set aside” for fraud, undue influence or other wrongful conduct.
Spousal Support
Two examples of temporary child and spousal support calculations using the DissoMaster program are shown below. Both examples have the husband earning $4,000 gross per month, and the wife earning $3,000 gross per month with the husband paying $500 per month in health insurance costs. The wife is residing in the family home with the parties’ two children and she is paying the mortgage interest of $1,000 per month and property taxes of $400 per month. In the first example, the husband has 25% timeshare with the two children, and his total support obligation per month is $748 per month. In the second example, the husband has the children 50% of the time (49.99%) and his total support obligation is $57 per month.

Sex Crimes
Physical injury is not required. However, not every altercation or argument between two people rises to the level of abuse or domestic violence. Conduct that amounts to “badgering” with no actual or threatened violence or sexual assault and that does not place a person in reasonable apprehension of imminent serious bodily injury to that person or other is not “abuse.”
Assault
Restraining Order
You should retain an attorney to help you with any domestic violence claim as soon as possible because if a restraining order is issued against you, it can have long-term impacts on you, including your right to have contact with your children and your access to your home. If a judge finds your have perpetrated domestic violence, the judge can issue a restraining order against you to protect your spouse and children for up to five years and a legal presumption is triggered that you should not share “joint legal” or “joint physical” custody of your children. Also, there are short timeframes and deadlines for your attorney to prepare your defense, so you should retain an attorney as soon as possible.

Construction Litigation
Prior to establishing her own law practice in 2005, Jackie worked for several years with the Law Office of Robert A. Smith (Deputy City Attorney for the City of Sonoma) and Pat Broderick (currently a Sonoma County Superior Court judge) representing over 80 homeowners in construction defect lawsuits against a major developer of mass-produced homes in Windsor, California.
